2. Coronavirus (COVID-19) – Mesures académiques exceptionnelles

Les membres sont informés que l’Université doit mettre en place des mesures académiques
exceptionnelles pour répondre à la crise sans précédent à laquelle nous devons faire face.

Annick Bergeron, secrétaire générale, explique la portée et le contenu de la motion, et résume
la note qui a été soumise aux sénateurs :

En réponse aux circonstances exceptionnelles et à l’évolution rapide de la situation entourant la
propagation de la maladie à coronavirus 2019 (COVID-19) au Canada et ailleurs dans le monde,
l’Université a mis en place des mesures pour assurer la continuité des activités académiques en
se conformant aux conseils et directives des autorités de santé publique;

Plusieurs de ces mesures ont déjà été mises en place et d’autres devront l’être dans les jours et
les semaines à venir. Ces mesures sont notamment l’enseignement à distance pour tous les
cours sous différentes formes, des changements dans la façon de fournir l’enseignement, des
changements dans les modes et méthodes d’évaluation, des changements dans la notation etc.
Les mesures sont déterminées par les professeurs pour tout ce qui concerne les méthodes
d’enseignement et d’évaluation comme c’est l’usage. Les changements à la notation sont
déterminés par le doyen, le conseil de faculté ou son comité exécutif comme ce l’est
normalement. En d’autres termes, l’autorité pour prendre les décisions à l’intérieur des facultés
demeure la même qu’en temps normal.

Les directions facultaires vont émettre des lignes directrices pour guider et faciliter le travail des
professeurs dans les décisions et les moyens qu’ils doivent mettre en place.
Les mesures académiques exceptionnelles doivent être prises dans une perspective de
continuité des activités académiques dans un souci de protection de la santé et de la sécurité de
notre communauté et de l’ensemble de la population. De façon plus spécifique, l’université met
de l’avant les principes suivants dans l’établissement des mesures exceptionnelles:

• La flexibilité et l’équité pour les étudiants
• L’agilité, la flexibilité et l’autonomie des directions facultaires et des professeurs
• L’atteinte des objectifs pédagogiques et le respect des standards académiques
• L’intégrité académique
• Le respect de la liberté académique
• Le respect de nos obligations en matière d’accommodement académique, accessibilité et
droits de la personne.

Members held a discussion on the ‘Pass or Fail’ grading option. The Provost indicated that it
would be up to each faculty to make this option available.

In terms of conducting and administering final examinations, it was explained that discussions
are being held with the Ontario government and universities, and the Provost expects to receive
information soon that she will share with the faculties.

Other points discussed related to the authority that faculties and professors have to make
decisions regarding temporary academic measures, student academic appeals and the delivery
of distance courses.

Members proceeded to vote on the proposed motion.

2019-2020.055 On motion duly made and seconded, it is resolved to :

“WHEREAS in response to the evolving and significant exceptional circumstances regarding the
spread of the Coronavirus COVID-19 in Canada and internationally and in the interest of the
health and safety of the University community while ensuring, to the extent possible, the
continuity of academic activities, the University has put in place temporary measures to manage
the situation and to be consistent with the advice of public health officials;

AND WHEREAS such temporary measures may need to change and take immediate effect as
the Coronavirus COVID-19 situation evolves and could result in changes to the class/ course
schedule, the course syllabus, academic deadlines, the method of teaching and evaluation,
other academic activities or in exceptions to the University’s Academic Regulations or to faculty specific academic regulations;

AND WHEREAS while such temporary measures are necessary, upholding academic standards
and academic integrity, respecting learning outcomes of academic programs and ensuring the
delivery of courses in an online and/or distance learning environment, must continue to remain
as fundamental values at the core of all academic activities;

AND WHEREAS such temporary measures are necessary until such time as public health
officials advise that normal business operations can return. At such time, the Senate Executive
will reconvene to rescind this resolution;

NOW THEREFORE ON MOTION DULY MADE AND SECONDED, be it resolved that,

1. In response to the evolving and significant exceptional circumstances regarding the
Coronavirus COVID-19 and in the interest of the health and safety of the University community
while ensuring, to the extent possible, the continuity of academic activities,

a. the Senate hereby recognizes that temporary academic measures,

i. are legitimate and necessary to manage the Coronavirus COVID-19 situation and to be
consistent with the evolving advice of public health officials; and

ii. have resulted in or could in future result in changes to a class/course schedule, a course
syllabus, an academic deadline, a method of teaching or evaluation, grading or other
academic activities; and

iii. may need to change unexpectedly with immediate effect;

and

b. the Senate hereby approves that temporary academic measures,

i. have resulted in or could in future result in exceptions to the University’s Academic
Regulations, to faculty-specific academic regulations, to a class/course schedule, a course
syllabus, an academic deadline, a method of teaching or evaluation, grading or other
academic activities; and

ii. shall take precedence, on an exceptional basis, over the course syllabus and the
University’s Academic Regulations and faculty-specific academic regulations (subject to the
University’s religious accommodation and academic accommodation obligations contained in
the University’s Academic Regulations I-15 and I-16, respectively, and to its accessibility and
other obligations under human rights laws);

2. Upholding academic standards and academic integrity, respecting learning outcomes of
academic programs and ensuring the delivery of courses in an online and/or distance learning
environment must continue to remain as fundamental values at the core of all academic
activities. If a student initiates a grade review or appeal or an appeal of a work-term grade, a
placement or an internship, such review or appeal cannot be solely due to the temporary
academic measures associated with the University’s response to the Coronavirus COVID-19,
but rather must be supported by additional justifiable grounds.

3. The Senate hereby delegates to the Executive Committee of Senate, the power and authority
to act on behalf of the Senate, as needed, on the following, save and except where the Senate
has reserved its powers or has delegated its powers to another Senate committee:

a. to determine and adjust the academic direction and policy in connection with temporary
academic measures; and

b. to deal with any other academic matter pertaining to temporary academic measures
associated with the University’s response to the Coronavirus COVID-19.

4. In the event of an emergency and should a duly convened meeting of the Executive
Committee of Senate fail to produce a quorum or should it not, in the opinion of the President,
due to the urgency of the matter, be practical to convene a meeting of the Executive Committee
of the Senate, then the Provost and Vice-President Academic Affairs, after consultation with the
President, shall have the power and authority to act on behalf of the Senate in respect of
paragraph 3 of this Resolution; thereafter, a meeting of the Executive Committee of Senate shall
be convened at the earliest practical opportunity and a full report on any actions or decisions
taken or made by the Provost and Vice-President Academic Affairs shall be made at such
meeting.

The motion passed with one vote against.

Members of the Senate,

At this extraordinary meeting of the Senate, we are presenting for your approval a motion to implement various academic measures that are required in response to the unprecedented crisis we currently face. This motion includes technical wording, and so we have included below a summary of the content, scope, and principles that underlie the motion.

In response to the exceptional circumstances and rapid evolution of the situation surrounding the spread of the COVID-19 coronavirus in Canada and around the world, the University has implemented measures to ensure the continuity of its academic activities while complying with the advice and guidance issued by public health authorities.

Several of these measures have already been implemented and others will be put in place in the coming days and weeks. These measures include various forms of distance learning for all courses, changes to the way we teach, changes to how we conduct exams and evaluate students, changes to our grading system, etc.

As is normally the case, professors are responsible for determining how they will teach and evaluate their students. Changes to grading systems will be determined by the dean, faculty council or its executive committee, as usual. In other words, the decision-making authorities within faculties remain the same as under normal circumstances.

Faculty managers will issue guidelines to direct and assist their professors in taking decisions and in implementing the required measures.

With the motion set before you today, the Senate will be approving the exceptional measures that have already been implemented and those to come. It will also be approving the resulting exceptions to, and exemptions from, University and faculty academic regulations.

These exceptional academic measures must be taken in order to preserve the continuity of our academic activities while protecting the health and safety of members of our University community and the public at large. More specifically, the University proposes the following principles as the basis for establishing these exceptional measures:

• Flexibility and fairness for students
• Agility, flexibility, and autonomy for professors and faculty managers
• Attainment of educational goals and compliance with academic standards
• Academic integrity
• Respect for academic freedom
• Compliance with our obligations to facilitate academic accommodation, accessibility, and human rights

2019-2020.055 On motion duly made and seconded, it is resolved to :

Sur motion dûment proposée et appuyée, il est résolu que :

ATTENDU qu’en réponse aux circonstances exceptionnelles et à l’évolution rapide de la situation entourant la propagation de la maladie à coronavirus 2019 (COVID-19) au Canada et ailleurs dans le monde, dans l’intérêt de la santé et de la sécurité de la communauté universitaire et tout en assurant, dans la mesure du possible, la continuité des activités universitaires, l’Université a mis en place des mesures temporaires afin de gérer la situation et de se conformer aux conseils des autorités de santé publique;

ET ATTENDU qu’il est possible que de telles mesures temporaires pourraient devoir changer et entrer en vigueur au fur et à mesure que la situation entourant la COVID-19 évolue, et qu’elles pourraient mener à des modifications à l’horaire des cours/examens, aux plans de cours, aux dates limites de remise de travaux, aux modes d’enseignement et d’évaluation ou à toute autre activité liée aux études, ou encore à des exceptions aux règlements académiques de l’Université ou des facultés;

ET ATTENDU que bien que ces mesures temporaires soient nécessaires, le maintien des standards et de l’intégrité des programmes, le respect des objectifs d’apprentissage et la prestation de cours en ligne ou à distance doivent demeurer des valeurs fondamentales au coeur de toutes les activités académiques;

ET ATTENDU que ces mesures temporaires seront nécessaires jusqu’à ce que les autorités de santé publique permettent la reprise des activités habituelles. Les membres du Comité exécutif se réuniront alors pour annuler la présente résolution;

SUR MOTION DÛMENT PROPOSÉE ET APPUYÉE, il est résolu que,

1. En réponse aux circonstances exceptionnelles et à l’évolution rapide de la situation entourant la propagation de la maladie à coronavirus 2019 (COVID-19) et dans l’intérêt de la santé et de la sécurité de la communauté universitaire, tout en assurant, dans la mesure du possible, la continuité des activités universitaires,

a. le Sénat reconnaît par la présente que des mesures académiques temporaires,

i. sont légitimes et nécessaires à la gestion de la situation entourant la COVID-19, et conformes aux plus récents conseils des autorités de santé publique; et

ii. ont mené ou pourraient mener à des modifications à l’horaire d’un cours/d’un examen, à un plan de cours, à une date limite de remise de travail, à un mode d’enseignement ou d’évaluation, à l’attribution des notes ou à toute autre activité liée aux études; et

iii. pourraient être modifiées sans préavis et mises en vigueur sur-le-champ;

et

b. le Sénat approuve par la présente le fait que des mesures académiques temporaires,

i. ont mené ou pourraient dans l’avenir mener à des exceptions aux règlements académiques de l’Université et des facultés, à l’horaire d’un cours/examen, à un plan de cours, à une date limite de remise de travail, à un mode d’enseignement ou d’évaluation, à l’attribution des notes ou à toute autre activité liée aux études; et

ii. doivent exceptionnellement avoir préséance sur les plans de cours et les règlements académiques de l’Université et des facultés (dans le respect des obligations concernant les accommodements religieux et académiques énoncés aux règlements académiques I-15 et I-16 respectivement et de leurs obligations en vertu des droits de la personne et en matière d’accessibilité);

2. Le maintien des standards et de l’intégrité des programmes, le respect des objectifs d’apprentissage, et la prestation de cours en ligne ou à distance doivent demeurer des valeurs fondamentales au coeur de toutes les activités académiques. Si un étudiant ou une étudiante entame des démarches de révision de note ou d’appel, ou fait appel de sa note de stage, de placement ou d’internat, cette révision ou cet appel ne doit pas reposer uniquement sur les mesures temporaires mises en place par l’Université en réponse à la COVID-19, mais s’appuyer sur des motifs supplémentaires valables.

3. Par la présente, le Sénat délègue au Comité exécutif du Sénat le pouvoir et l’autorité d’agir en son nom, au besoin, en ce qui a trait aux points suivants, sauf si le Sénat a conservé ses pouvoirs ou les a délégués à un autre comité du Sénat :

a. Déterminer et ajuster l’orientation et la politique académique en lien avec les mesures temporaires; et

b. Traiter toute autre situation en lien avec les mesures académiques temporaires mises en place par l’Université en réponse à la COVID-19.

4. En cas d’urgence, et s’il n’y a pas quorum lors d’une réunion dûment convoquée du Comité exécutif du Sénat, ou s’il n’est pas pratique, selon le recteur, étant donné l’urgence de la situation, de convoquer une réunion du Comité exécutif du Sénat, la provost et vice-rectrice aux affaires académiques, après consultation avec le recteur, aura le pouvoir et l’autorité d’agir au nom du Sénat en vertu du paragraphe 3 de la présente résolution. Par la suite, une réunion du Comité exécutif du Sénat sera convoquée dès que possible et un rapport sur les actions ou les décisions prises par la provost et vice-rectrice aux affaires académiques y sera présenté.
