Language Provisions of the Spanish Constitution

Context

The Spanish Constitution of December 28, 1978, established a quasi-federal system based on autonomous regions, each with their own parliament and regional government. The Central Parliament is composed of two chambers. Some of the autonomous regions, such as Catalonia, Valencia, Basque Country and Galicia enjoy a degree of autonomy that allows two official languages. One of the interesting features of the Spanish Constitution is that it requires all citizens to know the official language of the Spanish State.

The 1978 Constitution was adopted in Castilian Spanish, but official versions were later offered in Catalan, Basque and Galician

Artículo 3

  1. El castellano es la lengua española oficial del Estado. Todos los españoles tienen el deber de conocerla y el derecho a usarla.
  2. Las demás lenguas españolas serán también oficiales en las respectivas Comunidades Autónomas de acuerdo con sus Estatutos.
  3. La riqueza de las distintas modalidades lingüisticas de España es un patrimonio cultural que será objeto de especial respeto y protección.

Artículo 20.3

La ley regulará la organización y el control parlamentario de los medios de comunicación social dependientes del Estado o de cualquier ente público y garantizará el acceso a dichos medios de los grupos sociales y políticos significativos, respetando el pluralismo de la sociedad y de las diversas lenguas de España.

Artículo 148

  1. Las Comunidades Autónomas podrán asumir competencias en las siguientes materias:

    1o Organización de sus instituciones de autogobierno;

17. El fomento de la cultura, de la investigación y, en su caso, de la enseñanza de la lengua de la Comunidad Autónoma.

DISPOSICIÓN FINAL

Esta Constitución entrará en vigor el mismo día de la publicación de su texto oficial en el « Boletín Oficial del Estado ». Se publicará también en las demás lenguas de España. Por tanto, mando a todos los españoles, particulares y autoridades, que guarden y hagan guardar esta Constitución como norma fundamental del Estado.

Article 3 [Official Language]

  1. Castilian is the official Spanish language of the state. All Spaniards have the duty to know it and the right to use it.
     
  2. The other languages of Spain will also be official in the respective autonomous communities, in accordance with their Statutes.
  3. The richness of the linguistic modalities of Spain is a cultural patrimony which will be the object of special respect and protection.

Article 20 [Specific Freedoms, Restrictions]

(3) The law shall regulate the organization and parliamentary control of the means of social communication owned by the State or any public entity and shall guarantee access to those means by significant social and political groups, respecting the pluralism of society and the various languages of Spain.
 

Article 148 [Competences]

  1. (1) The Autonomous Communities may assume competences in the following:

    1oorganization of their institutions of self-government;

17. promotion of culture, research, and, when applicable, the teaching of the language of the Autonomous Community;

Final Provision

This Constitution shall come into force on the day of publication of its official text in the Official State Gazette (Boletín Oficial del Estado). It shall also be published in the other languages of Spain. Wherefore, we order all Spaniards, whether individuals or authorities, to abide by this Constitution and ensure that it is observed as a Fundamental Law of the State.
